1. Acceptance of Terms

By accessing or using RaiseReady (the "Service"), operated by E Stream Media Empire ("we", "our", "us"), you agree to these Terms of Service. If you do not agree, do not use the Service. These Terms apply only to RaiseReady and not to any other product operated by us.

2. Nature of the Service (Important)

RaiseReady is an educational business-planning and funding-readiness tool. It is not, and must not be relied upon as:

• a financial service, investment advisor, or financial planner;
• a loan broker, fundraising platform, or securities platform;
• a provider of legal, tax, accounting, or regulated financial advice.

AI-generated content, milestones, assessments, and reports are for planning and educational purposes only. We do not guarantee funding, loan approval, listing eligibility, valuation outcomes, investor interest, or business success. You must consult a licensed professional before making any financial, legal, or investment decision.

3. Eligibility & Accounts

You must be at least 16 years old and capable of forming a binding contract. You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly of any unauthorised use.

4. Acceptable Use

You agree not to: (a) use the Service unlawfully; (b) attempt to gain unauthorised access to systems or other users' data; (c) reverse engineer, scrape, or disrupt the Service; (d) upload unlawful, infringing, or malicious content; or (e) use the Service to provide regulated financial services to third parties.

5. AI Features

AI features are powered by Claude (Anthropic), with OpenAI as a fallback, and on-device Apple Intelligence on supported iOS devices. AI output may be inaccurate or incomplete. All AI suggestions are suggestions only; you remain solely responsible for any action you take. Every AI response and report carries a disclaimer to this effect.

6. Subscriptions, Trials & Payments

RaiseReady offers Free, Plus, Pro, and Max tiers.

• Web payments are processed by Stripe.
• iOS payments are processed exclusively through Apple in-app purchase (StoreKit). For iOS subscriptions, billing, renewal, and cancellation are managed through your Apple ID account settings, in accordance with Apple's terms.
• Subscriptions auto-renew unless cancelled before the end of the current period. Trials convert to paid unless cancelled before the trial ends.
• There are no lifetime plans.

Permissions are granted based on your highest active subscription across platforms. Prices may change with prior notice.

7. Referral Program (Web only)

Any referral program is offered through raiseready.net only and is not part of the iOS app. Referral credit, where offered, may offset future RaiseReady web invoices only and has no cash value unless expressly stated.

8. User Content & Ownership

You retain ownership of the business data and documents you submit. You grant us a limited licence to host and process that content solely to provide the Service. You are responsible for the accuracy and legality of content you submit.

9. Intellectual Property

The Service, including its software, design, and content (excluding your data), is owned by E Stream Media Empire and protected by applicable laws. You may not copy, modify, or distribute it without permission.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate or suitable for your circumstances.

11. Limitation of Liability

To the maximum extent permitted by law, E Stream Media Empire shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, funding, revenue, data, or business opportunity, arising from your use of or reliance on the Service. Our total aggregate liability shall not exceed the amount you paid us for the Service in the 12 months preceding the claim.

12. Indemnity

You agree to indemnify and hold harmless E Stream Media Empire from any claims, losses, or expenses arising from your misuse of the Service or breach of these Terms.

13. Termination

We may suspend or terminate your access if you breach these Terms. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination (e.g. disclaimers, liability, IP) survive.

14. Governing Law

These Terms are governed by the laws of Malaysia. Disputes shall be subject to the jurisdiction of the Malaysian courts, without prejudice to mandatory consumer-protection rights in your jurisdiction.

15. Changes to These Terms

We may update these Terms. Material changes will be notified in-app or by email, and the effective date above will be updated. Continued use after changes constitutes acceptance.

AI 生成的内容、里程碑、评估与报告仅供规划与教育用途。我们不保证融资、贷款批准、上市资格、估值结果、投资人兴趣或经营成功。在做出任何财务、法律或投资决定前,您必须咨询持牌专业人士。

3. 资格与账户

您须年满 16 周岁并具备订立有效合同的能力。您有责任保管登录凭证,并对账户下的一切活动负责。如发现未经授权使用,请及时通知我们。

4. 可接受使用

您同意不:(a)非法使用本服务;(b)试图未经授权访问系统或他人数据;(c)逆向工程、抓取或干扰本服务;(d)上传违法、侵权或恶意内容;(e)利用本服务向第三方提供受监管的金融服务。

5. AI 功能

AI 功能主要由 Claude(Anthropic)提供,OpenAI 作为备用,受支持的 iOS 设备可使用本机 Apple Intelligence。AI 输出可能不准确或不完整。所有 AI 建议仅为建议,您须对自己采取的任何行动独自负责。每条 AI 回复与报告均附带相应免责声明。

6. 订阅、试用与支付

RaiseReady 提供 Free、Plus、Pro、Max 套餐。

• 网页端支付由 Stripe 处理。
• iOS 端支付完全通过 Apple 应用内购买(StoreKit)处理。iOS 订阅的扣费、续订与取消均通过您的 Apple ID 账户设置管理,并遵守 Apple 的条款。
• 除非在当前周期结束前取消,订阅将自动续订。除非在试用结束前取消,试用将转为付费。
• 不提供终身套餐。

权限依据您在各平台中最高的有效订阅授予。价格调整将提前通知。

7. 推荐计划(仅限网页端)

任何推荐计划仅通过 raiseready.net 提供,不属于 iOS 应用的一部分。如提供推荐积分,仅可抵扣未来的 RaiseReady 网页端账单,除非明示否则无现金价值。

8. 用户内容与归属

您保留对所提交的企业数据与文件的所有权。您授予我们有限许可,仅为提供本服务而托管和处理该等内容。您须对所提交内容的准确性与合法性负责。

9. 知识产权

本服务(含其软件、设计与内容,但不含您的数据)归 E Stream Media Empire 所有,并受适用法律保护。未经许可,您不得复制、修改或分发。

10. 免责声明

本服务按"现状"与"现有"基础提供,不作任何明示或默示担保,包括适销性、特定用途适用性、准确性或不侵权。我们不保证服务不中断、无错误,或 AI 输出准确、适用于您的具体情况。

11. 责任限制

在法律允许的最大范围内,对于因您使用或依赖本服务而产生的任何间接、附带、特殊、后果性或惩罚性损害,或任何利润、融资、收入、数据或商业机会的损失,E Stream Media Empire 概不负责。我们的累计责任总额不超过您在索赔前 12 个月内为本服务支付给我们的金额。

12. 赔偿

对于因您滥用本服务或违反本条款而引起的任何索赔、损失或费用,您同意赔偿并使 E Stream Media Empire 免受损害。

13. 终止

若您违反本条款,我们可暂停或终止您的访问。您可随时停止使用并删除账户。依其性质应在终止后继续有效的条款(如免责声明、责任限制、知识产权)将继续有效。

14. 适用法律

本条款受马来西亚法律管辖。争议应受马来西亚法院管辖,但不影响您所在辖区的强制性消费者保护权利。

15. 条款变更

我们可能更新本条款。重大变更将通过应用内或电子邮件通知,并更新上方生效日期。变更后继续使用即视为接受。
